Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Kamity regarding your access to and use of our website, applications, and related services (the “Service”).

By creating an account, signing in, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Kamity helps communities organize committees, members, festivals, activities, finance records, and photo galleries. Some features are public (such as discovering nearby festivals); others require an authenticated account and committee membership.

We may improve, change, suspend, or discontinue parts of the Service with reasonable notice when practicable. We do not guarantee uninterrupted or error-free operation.

• You must be legally able to enter a binding contract in your jurisdiction (and at least 18 years old, unless we expressly allow otherwise).
• You sign in with a mobile number and one-time password (OTP). Keep your phone secure and do not share OTP codes.
• You are responsible for activity under your account. Notify us promptly of unauthorized access.
• Provide accurate profile information and keep it up to date.

Committee owners and authorized members control who can join and what they can view or edit. You are responsible for:

• Content and data you upload or enter (including photos and finance entries)
• Permissions you grant to other members
• Ensuring you have rights to share any personal data of others you add to a committee
• Complying with applicable laws when organizing events and handling community funds

Publically visible festival or committee information may appear in discovery experiences. Do not publish private or sensitive information you do not intend to share.

You agree not to:

• Violate any law or third-party rights
• Harass, abuse, or harm others, or upload unlawful, defamatory, or infringing content
• Attempt to gain unauthorized access to accounts, systems, or data
• Probe, scan, or overload the Service, or interfere with its security
• Use the Service to send spam, malware, or deceptive communications
• Misrepresent your identity or affiliation with a committee
• Scrape or harvest data from the Service except as allowed by documented public APIs and robots rules

We may suspend or terminate access for violations, suspected fraud, or risk to other users or the Service.

Finance tools help committees record income and expenses. Kamity is not a bank, payment processor, auditor, or tax advisor. Records you enter are for organizational convenience only. You remain solely responsible for financial accuracy, compliance, and any real-world payments outside the Service.

Nearby discovery may use your device location (with permission) or a place you search. Map and directions features may rely on third-party map providers. Location accuracy is not guaranteed. Always follow local laws and safety guidance when traveling to events.

The Service, including its design, software, and branding, is owned by Kamity or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service as permitted by these Terms.

You retain ownership of content you submit. You grant Kamity a worldwide, non-exclusive license to host, store, display, and process that content as needed to operate the Service (including showing public discovery content you choose to publish).

The Service may integrate SMS providers, hosting, maps/place search, and similar vendors. Their terms and privacy practices apply to their services. We are not responsible for third-party sites or services we do not control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that event listings, locations, member data, or finance records are complete or accurate.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kamity AND ITS AFFILIATES, OFFICERS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) INR 5,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to defend and indemnify Kamity against claims, damages, and expenses arising from your content, your use of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, and indemnity) will survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in Hyderabad, Telangana, India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply in your place of residence.

We may update these Terms periodically. We will post the updated version on this page and revise the effective date. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.
